Article 1 – Definitions
In these Terms and Conditions, the following definitions apply:
Withdrawal period: the period during which the consumer can exercise the right of withdrawal.
Consumer: the natural person not acting on behalf of a company or profession and who enters into a distance agreement with the entrepreneur.
Day: calendar day
Subscription transaction: a distance agreement relating to a series of products and services where the delivery obligation and purchasing are spread over a period of time.
Durable Medium: any instrument which enables the recipient or the entrepreneur to store information addressed personally to them in a way accessible for future reference for a period of time adequate to the purpose of the information and which allows the unchanged reproduction of the stored information.
Right of Withdrawal: the possibility for the consumer to cancel the distance agreement within the withdrawal period.
Entrepreneur: the natural person or corporation who offers products at a distance to consumers.
Distance Agreement: an agreement concluded within an organized system for distance sales of products and services, including the conclusion of an agreement using one or more techniques of distance communication.
Distance Communication Technique: a means that can be used to conclude an agreement without the consumer and the entrepreneur meeting together in the same place at the same time.

Article 3 - Applicability
These general terms and conditions apply to any offer from the entrepreneur and to every concluded distance agreement between entrepreneur and consumer.
Before the distance agreement is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the distance agreement is concluded that the general terms and conditions can be viewed at the entrepreneur's premises and that they will be sent to the consumer as soon as possible free of charge upon request.
If the distance agreement is concluded electronically, notwithstanding the previous paragraph and before the distance agreement is concluded, the text of these general terms and conditions can be made available electronically to the consumer in such a way that it can be easily stored by the consumer on a durable medium. If this is not reasonably possible, it will be indicated before the distance agreement is concluded where the general terms and conditions can be consulted electronically and that they will be sent electronically or otherwise to the consumer free of charge upon request.
In the event that specific product or service conditions also apply in addition to these general terms and conditions, the second and third paragraphs apply accordingly, and in case of conflicting terms and conditions, the consumer may always rely on the applicable provision that is most favorable to them.
Article 4 - Offer
If an offer has limited validity or is subject to conditions, this will be explicitly stated in the offer.
The offer contains a complete and accurate description of the products and services offered. The description is sufficiently detailed to enable a proper assessment of the offer by the consumer. Images used by the entrepreneur are truthful representations of the products and services offered. Obvious mistakes or errors in the offer do not bind the entrepreneur.
Each offer contains such information that it is clear to the consumer what rights and obligations are attached to accepting the offer. This concerns in particular:
• price including taxes
- possible delivery costs
- the manner in which the agreement will be concluded and any necessary actions
- whether the right of withdrawal applies
- the method of payment, delivery and performance of the contract
- the deadline for accepting the offer or the period during which the entrepreneur guarantees the price
- the level of charges for distance communication if the costs of using distance communication technology are calculated on a basis other than the regular basic rate
- whether the agreement is archived after conclusion and if so, how it can be consulted by the consumer
- the way in which the consumer can check the information provided by them under the agreement before concluding the agreement, and if necessary correct it
- any other languages, besides Dutch, in which the agreement is available
- the codes of conduct to which the entrepreneur is subject and the way in which the consumer can consult these codes of conduct electronically; and
- the minimum duration of the distance agreement in the case of subscription transactions.
Article 5 - The Agreement
The agreement is concluded, subject to the provisions in paragraph 4, at the moment the consumer accepts the offer and fulfills the stated conditions.
If the consumer has accepted the offer electronically, the entrepreneur immediately confirms electronically the receipt of the acceptance of the offer. As long as the receipt of this acceptance has not been confirmed by the entrepreneur, the consumer can cancel the agreement.
If the agreement is concluded electronically, the entrepreneur will take appropriate technical and organizational measures to secure the electronic data transfer and ensure a safe web environment. If the consumer can pay electronically, the entrepreneur will observe appropriate security measures.
Within legal frameworks, the entrepreneur may inform themselves whether the consumer can meet their payment obligations, as well as all facts and factors that are important for responsibly entering into the distance agreement. If the entrepreneur has good grounds based on this investigation not to enter into the agreement, they are entitled to refuse an order or request with reasons or attach special conditions to the execution.
The entrepreneur shall provide the following information with the product, service or digital content to the consumer, in writing or in such a way that it can be stored by the consumer in an accessible manner on a durable medium:
- The visiting address of the entrepreneur's establishment where the consumer can lodge complaints
- The conditions under which and the way in which the consumer can exercise the right of withdrawal, or a clear statement regarding the exclusion of the right of withdrawal
- Information about warranties and existing after-sales service
- The information included in Article 4 paragraph 3, unless the entrepreneur has already provided this information to the consumer before the execution of the agreement
- The requirements for terminating the agreement if the agreement has a duration of more than one year or is of indefinite duration
In the case of subscription transactions, the provision in the previous paragraph only applies to the first delivery.
Article 6 - Right of Withdrawal
For products:
When purchasing products, the consumer has the possibility to cancel the agreement without giving reasons within 14 days. This withdrawal period starts on the day after the consumer, or a third party designated by the consumer who is not the carrier, receives the product.
During the withdrawal period, the consumer shall handle the product and packaging carefully. They shall only unpack or use the product to the extent necessary to determine whether they wish to keep the product. If they wish to exercise the right of withdrawal, they shall return the product with all accessories and - if reasonably possible - in the original condition and packaging to the entrepreneur, in accordance with reasonable and clear instructions provided by the entrepreneur.
For services:
When purchasing services, the consumer has the possibility to cancel the agreement without giving reasons for at least 14 days, starting on the day the agreement is entered into.
To exercise the right of withdrawal, the consumer must follow the reasonable and clear instructions provided by the entrepreneur with the offer or at the latest upon delivery of the service.
Article 7 - Withdrawal Costs
If the consumer exercises the right of withdrawal, they will bear no more than the direct costs of returning the product.
If the consumer has made a payment, the entrepreneur shall refund this amount as soon as possible but no later than within 14 days after withdrawal or after the return shipment.
Article 8 - Exclusion of Right of Withdrawal
The entrepreneur can exclude the consumer's right of withdrawal only for the products listed in paragraphs 2 and 3. The exclusion of the right of withdrawal only applies if the entrepreneur has clearly stated this at least before the conclusion of the agreement.
Exclusion of the right of withdrawal is only possible for the following products:
- Products that are made by the entrepreneur according to the consumer's specifications
- Products that are clearly personal in nature
- Products that cannot be returned due to their nature
- Perishable products that can spoil or age quickly. More information about withdrawal rights for perishable products
- Products whose price is subject to fluctuations in the financial market over which the entrepreneur has no influence
- Individual newspapers and magazines
- Products for which it cannot be established that they are the original products delivered by Next Level
Article 9 - Pricing
During the validity period stated in the offer, the prices of the offered products and services will not be increased, except for price changes due to changes in VAT rates.
Contrary to the previous paragraph, the entrepreneur may offer products and services with variable prices when these prices are subject to fluctuations in the financial market over which the entrepreneur has no influence. This dependence on fluctuations and the fact that any stated prices are target prices will be mentioned in the offer.
Price increases within 3 months after the conclusion of the agreement are only permitted if they result from legal regulations or provisions.
Price increases from 3 months after the conclusion of the agreement are only allowed if the entrepreneur has stipulated this and:
- They result from legal regulations or provisions; or
- The consumer has the authority to terminate the agreement from the day the price increase takes effect.
The prices mentioned in the offer include VAT.
Article 10 - Conformity and Guarantees
The entrepreneur ensures that the products and services comply with the agreement, the specifications stated in the offer, reasonable requirements of reliability and/or usability, and the legal provisions and/or government regulations existing on the date of conclusion of the agreement. If agreed, the entrepreneur also ensures that the product is suitable for other than normal use.
A warranty provided by the entrepreneur, manufacturer or importer never limits the legal rights and claims that the consumer can assert against the entrepreneur under the agreement.
Article 11 - Delivery and Execution
The entrepreneur shall exercise the greatest possible care when receiving and executing orders for products and when assessing applications for the provision of services.
The place of delivery is the address that the consumer has made known to the entrepreneur.
With due observance of what is stated in Article 4 of these general terms and conditions, the entrepreneur will execute accepted orders expeditiously but no later than within 30 days, unless a different delivery period has been agreed. If delivery is delayed, or if an order cannot be executed or can only be partially executed, the consumer will receive notice of this no later than 30 days after placing the order. In that case, the consumer has the right to cancel the agreement without costs and is entitled to any compensation.
After cancellation in accordance with the previous paragraph, the entrepreneur will refund the amount that the consumer has paid as soon as possible.
If delivery of an ordered product proves impossible, the entrepreneur will endeavor to make available a replacement product. At the latest upon delivery, it will be clearly and comprehensibly stated that a replacement product is being delivered. For replacement products, the right of withdrawal cannot be excluded. The costs of any return shipment are at the entrepreneur's expense.

Article 12 - Subscription transactions: duration, termination and extension
Termination:
The consumer can terminate at any time an agreement that has been entered into for an indefinite period and that extends to the regular delivery of products (including electricity) or services, observing the agreed termination rules and a notice period of no more than one month.
The consumer can terminate at any time an agreement entered into for a definite period and that extends to the regular delivery of products (including electricity) or services at the end of the definite period, observing the agreed termination rules and a notice period of no more than one month.
The consumer can, regarding the agreements mentioned in the previous paragraphs:
• terminate at any time and not be restricted to termination at a specific time or during a specific period
- terminate in at least the same way as they were entered into
- always terminate with the same notice period as the entrepreneur has stipulated for themselves.
Extension:
An agreement that has been entered into for a definite time and that extends to the regular delivery of products (including electricity) or services may not be tacitly extended or renewed for a fixed duration.
Contrary to the previous paragraph, an agreement that has been entered into for a definite time and that extends to the regular delivery of daily newspapers, news and weekly magazines may be tacitly extended for a specified duration of maximum three months, if the consumer can terminate this extended agreement at the end of the extension with a notice period of no more than one month.
An agreement that has been entered into for a definite time and that extends to the regular delivery of products or services may only be tacitly extended for an indefinite period if the consumer may terminate at any time with a notice period of no more than one month and a notice period of no more than three months if the agreement extends to regular delivery, but less than once per month, of daily newspapers, news and weekly magazines.
An agreement with limited duration for the regular introductory delivery of daily newspapers, news and weekly magazines (trial or introductory subscription) will not be tacitly continued and ends automatically at the end of the trial or introductory period.
Duration:
If an agreement has a duration of more than one year, the consumer may terminate the agreement at any time after one year with a notice period of no more than one month, unless reasonableness and fairness oppose termination before the end of the agreed duration.
Article 13 - Payments
Unless otherwise agreed, amounts owed by the consumer must be paid within 7 days after the start of the withdrawal period referred to in Article 6, paragraph 1. In the case of an agreement to provide a service, this period starts after the consumer has received confirmation of the agreement.
When selling products to consumers, the consumer may never be required in general terms and conditions to pay more than 50% in advance. When advance payment has been stipulated, the consumer cannot assert any rights regarding the execution of the relevant order or service(s) before the stipulated advance payment has been made.
The consumer has the duty to report inaccuracies in provided or stated payment details to the entrepreneur immediately.
If the consumer fails to meet their payment obligations on time, after being notified by the entrepreneur of the late payment and the entrepreneur having granted the consumer a period of 14 days to still meet their payment obligations, following the failure to pay within this 14-day period, the consumer owes statutory interest on the amount still owed and the entrepreneur is entitled to charge the extrajudicial collection costs incurred.
Article 14 - Complaints
The entrepreneur has a sufficiently publicized complaints procedure and handles complaints in accordance with this complaints procedure.
Complaints about the execution of the agreement must be submitted fully and clearly described to the entrepreneur within a reasonable time after the consumer has discovered the defects.
Complaints submitted to the entrepreneur will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, the entrepreneur will respond within the 14-day period with an acknowledgment of receipt and an indication of when the consumer can expect a more detailed answer.
If the complaint cannot be resolved by mutual consultation, a dispute arises that is subject to the dispute resolution procedure.
Article 15 - Disputes
Dutch law applies exclusively to agreements between the entrepreneur and consumer to which these general terms and conditions relate.
All our products are natural and legal in the Netherlands. You must be 18+ to order. We recommend verifying compatibility with local regulations before purchasing. Once shipped internationally, parcels are subject to the destination country's postal system and regulatory framework. We cannot assume responsibility for shipments affected by local customs procedures or provide replacements/refunds for orders that do not complete delivery due to regulatory processes in the destination country.
Article 16 - Additional terms and conditions for UK Customers
Delivery time to the UK: 1-2 weeks
When ordering from the United Kingdom, please be aware that it can take up to 5 working days before we can ship your order. This is due to the necessary paperwork we have to prepare. Although we always try our best to ship your order as soon as possible, we ask for your patience after placing an order to the UK.
Please note that there is an increased chance of having to pay import fees to your courier service if the total amount of your order, including shipping costs, is above £135.
Article 17 - Additional and Different Provisions
Additional or different provisions from these general terms and conditions may not be to the detriment of the consumer and must be recorded in writing or in such a way that they can be stored by the consumer in an accessible manner on a durable medium.
